……………..Dealing with Stop and Search………………
It is legal and lawful for you to film the police conducting a search on public property as long as the person(s) being searched agree it is not invading their privacy. Work together and don’t obstruct the police, just collect evidence. As they approach start recording….
STOP & SEARCH / STOP & ACCOUNT…THE POLICE MUST TELL YOU:
O WHY they suspect YOU (except for Section 60 stops)
Ø WHAT LAW they are using
Ø Their NAME and badge NUMBER
Ø WHAT station they are from
Ø If they search you – WHAT they are LOOKING FOR
Ø Your right to a written record (RECEIPT)
This RECEIPT is to prove you were stopped and TO GET THE OFFICER’S DETAILS – YOU DON’T NEED TO GIVE YOUR DETAILS. It should be issued on the spot unless this is not practical.
DO check the RECEIPT has been filled in properly!

Not even to give your name or address, under ANY search powers.
A NAME AND ADDRESS IS USUALLY ONLY REQUIRED IF:
Ø You are stopped driving a vehicle
Ø The police believe you have committed an offence
Ø Anti social behaviour
/ You are given a court summons.

We advise that you DO NOT accept any charges including cautions, answer any questions (whether it be in a van or interview or otherwise) or sign anything without speaking to a legal advisor. There is no such thing as a ‘friendly chat’ – anything you say may be used in evidence.
If you are under 17 an appropriate adult (a parent or guardian or other responsible adult) will be required to be present during the interview.

GETTING LEGAL ADVICE
We advise that you ask to speak to a legal advisor straight away. The police may say that it will be quicker for them to deal with you without but this is unlikely to be in your best interest. We recommend that you don’t use the duty solicitor instead ask around and get someone to recommend you a solicitor, memorise the number or write it on this CRAP card.
